LEGAL FRAMEWORK OF EIA

The legal framework for the environmental impact assessment (EIA) originated with the enactment of Presidential Decree No. 1151 (the Philippine Environmental Policy). Comprehensive in scope, P.D. No. 1151 set forth various statements pertaining to a national environmental policy and goal in addition to advocating the “right to a healthy environment” and requirement of an EIS. Subsequently, an EIS system was adopted pursuant to Presidential Decree No. 1586. Following P.D. No. 1586, the NEPC promulgated a ten-year national environmental plan to operationalize specific guidelines enacted pursuant to the provisions of P.D. No. 1151. The following discussion contains the environmental declarations and plan of the NEPC.
