The Contract stipulates that the provision of Design, Specification and Scope of Work is the responsibility of the Employer. The Engineer issued the above named Variation Order in accordance with the provisions of Sub-Clause 51.3 & 51.4 of the General Conditions of the Contract. The process stipulated in the Supplemental Conditions of the Contract (Sub Clause 4.2 of Part-5) was not adopted due to lack of Design, Specification and Scope of works.
