Smart Meters: 1. TRESPASS: A. Body. RF travels through your body to its destination. B. Air Rights. RF travels through your property through the air…taking air rights w/o compensation. C. Devalue Property. If you live by a cell tower, your property values are decreased due to dangerous levels of RF. Also, in order to support smart grid, new telephone poles are being installed up to 3x the height of old poles. Due to unsightly poles and blocked views, property values may be further adversely impacted. D. Easements: Most current utility easements only cover delivery through wires…not through the air. E. Utility companies argue that they own the utility meters and can replace them, however, the utility company is delivering utilities under an easement and is given this privilege subject to obligations to safeguard property and persons and act in good faith. F. Utility companies will lie to you and tell you that your meter is not a smart meter…investigate by calling manufacturer and you will learn that it can be used as a smart meter at any time upon activation by remote signal. 2. UNCONSTITUTIONAL TAKING without Due Process: Article V: NO PERSON SHALL BE DEPRIVED OF LIFE, LIBERTY, OR PROPERTY, WITHOUT DUE PROCESS OF LAW; NOR SHALL PRIVATE PROPERTY BE TAKEN FOR PUBLIC USE, WITHOUR JUST COMPENSATION. 3. ILLEGAL: A. USC 18 Section 241 – Conspiracy against Rights: If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State in the free exercise or enjoyment of any right they shall be fined under this title or imprisoned not more than 10 years, or both. B. USC 18 Section 242 – Deprivation of Rights under Color of Law: Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State to the deprivation of any rights shall be fined under this title or imprisoned not more than one year, or both. C. USC 42 Section 1983 – Civil Action for Deprivation of Rights: Every person, who under color of any statute, ordinance, regulation, custom, or usage, of any State subjects, or causes to be subjected, any person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law. D. ADA, etc. Due to ability of smart grid to turn air conditioning and other appliances off at any time remotely, the ADA and other laws protecting those with disabilities, respiratory and other issues are violated and the health and safety of those individuals is jeopardized. 4. INCREASED COSTS: Consumer pays for pulsing and reading every 5 seconds. No means to verify readings since meters are digital. 5. HEALTH: FCC regulations allow 100x more RF than most other countries. FCC regulations permit higher levels of RF than any other industrialized country in the world…even China. 6. PRIVACY: Smart meters interact with chips on newer appliances and mechanical devices and create a profile on usage of user in violation of privacy and liberty rights. 7. YOU MUST NOTIFY THEM THAT YOU DO NOT CONSENT; OTHERWISE, YOUR CONSENT IS IMPLIED: A. Who: Notify all heads of public utility companies and governmental persons in charge. B. Accept their oaths of office. C. Once you accept their oaths of office, they are personally liable if they fail to honor their oath to support the Constitution.
