AFFIDAVIT FILED UNDER SECTION 139 C.P.C. I, Atchukatla Anjamma W/o.late Narasaiah, aged 35 years, Hindu, resident of D.No.3-48, S.C. Colony, Singannapalem Village, Mundlamur Mandal, Prakasam District, do hereby solemnly affirm and sincerely state as follows:I am the deponent herein and 1st petitioner in the above O.P. The petitioners 2to 5 are my children and petitioners 2 to 4 are being minors’ rep.by me as natural guardian. I am giving this affidavit on behalf of other petitioners also. The above O.P is filed for compensation for the death of my husband, who died in a Motor accident. I submit that my husband met with an accident and received critical injuries at Kalikivai cross road, Mulaguntapadu, S.Konda Mandal Prakasam District and died on the spot, on 06-05-2013 at about 1-30 a.m., and filing the above O.P. claiming compensation of Rs.6,00,000/- from the respondents 1 to 3 who are the driver, owner and Insurers of the Lorry bearing No.AP 16 TB 9577. We are suffering very much and our family members are not in a position to maintain ourselves. We are poor people. We have no cash in hand and at present, we are unable to pay the court fee of Rs.5,360/- in the above MVOP on compensation of Rs.6,00,000/-. I undertake to pay the Court Fee after passing of award in the above case. So, I therefore pray that the Hon’ble Court may be pleased to grant permission to exempt for payment of Court Fee of Rs.5,360/- in the above M.V.O.P., at present and number the enclosed MVOP and pass such other relies, in the interests of justice.
